PYRENEES HELISKI: TERMS AND CONDITIONS

INTRODUCTION

Your contract is with Pyrenees Heliski S.L (PH) a limited liability company registered in Spain with CIF (B25702408) with registered office at Carretera de Baqueira s/n, Heliport de Vielha, Betren, 25539. 

Your contract for the provision of heliskiing or other activities supplied by us incorporates these conditions and by making a booking you confirm your acceptance of them. Please note that accommodation is not supplied by us and is subject to terms and conditions specific to each accommodation. 

1. BOOKING AND PAYMENT 

1.1 YOUR BOOKING

1.1.1 When you make a booking and pay the relevant deposit we will make your booking on the basis of these Conditions and a binding contract between us will come into existence when we confirm acceptance of your booking in writing or by telephone. 

1.1.2 Any contract for a group booking will be made under the “Group Name” as indicated on our booking form. The person or agency as “Group Name” is responsible for ensuring that the other members of his/her group are aware of these conditions and that he/she consents to him/her acting on their behalf in dealing with us. Similarly all members of the group should familiarize themselves with our “terms and conditions”.

1.2 TERMS OF PAYMENT

1.2.1 We reserve the right to change the prices shown in any of our promotional information or on our website and you will be informed of any price changes at the time of booking. 

1.2.2 Payments can be made by bank transfer and/or credit or debit card (VISA, MASTERCARD).

1.2.3 Advance payment: To secure the booking an advance payment indicated by our booking office and failing that, 35% of the total price of the package, is required at the time of booking confirmation. If the booking office does not receive the deposit within two weeks of completing the booking form, PH may refuse to offer the travel services and require cancellation charges in accordance with point 3. If an incomplete group booking is made, 100% of the booking made must be paid. 

1.2.4 Balance payment: The second payment of 35% is due 120 days prior to arrival and the balance of 30% 60 days prior to arrival. If payment is not made within this time limit, PH may refuse to provide the travel services and require cancellation charges, in accordance with point 1.2.5. 

1.3 GROUPS 

1.3.1Our heliski classic 1/2 day and full day prices are based on groups of 4 skiers, depending on the program or package. When your group consists of less than the stated number (or multiple) you will be put on our stand-by list until the remaining places are filled. In the event of not being able to fill the remaining places, you can do the activity at an additional cost or the places will continue to be kept on the stand-by list. 

1.3.2 Our package prices are based on a minimum number of participants. If the minimum number of participants is not reached, additional costs may be incurred and will be informed at the time of booking.

 

3. CHANGES AND CANCELLATIONS

Cancellations must be confirmed in writing. The moment PH receives this cancellation confirmation is the “CANCELLATION DATE”, for Saturdays, Sundays and public holidays, the next working day is used. If the cancellation date is before December 1st PH will refund the balance of your account minus the initial deposit. The initial deposit once made will not be refunded under any circumstances. There are no refunds of any kind for cancellations made after December 1st.

3.1 CHANGES AND CANCELLATIONS BY PH OF NON-HELICOPTER PROGRAMS 

In case of cancellation, modification of your booking (snowshoeing, freeride and ski touring, skiing) due to adverse weather conditions PH will assign you a provisional date based on availability and will keep the total amount of your booking for a maximum period of 1 year. If you wish to request a refund, PH will charge 20%/pers of the total amount of the program as an administration fee. The administration charges will not be covered by the cancellation charge insurance.  

3.2 CHANGES AND CANCELLATIONS BY PH IN 1/2 DAY, 1 DAY AND PRIVATE PROGRAMS DUE TO ADVERSE WEATHER CONDITIONS.

In case of cancellation, modification of your booking due to adverse weather conditions PH will assign you a provisional date based on availability and will keep the total amount of your booking for a maximum period of 1 year. If you wish to request a refund, PH will reimburse you for the descents not made ( €100.-/pers./descent – based on groups of 4 people- ) for Classic full day AND 1/2 day programs. For Private programs, the amount charged will be refunded minus the corresponding management fees: 

– Groups of 3 skiers: PH will charge a sum of 770€/pers corresponding to management fees and exclusive helicopter reservation. 

  • Groups of 8 or more skiers: PH will charge an amount of 290€/pers corresponding to management fees and exclusive helicopter reservation. The management charges will not be covered by the cancellation charge insurance.

3.3 TRANSFER OF DEPOSIT OR RESERVES

Deposits and/or reservations are transferable (change of name) only under the following conditions: 

– The replacement traveller must accept the contract under the stipulated conditions. He/she must also meet the particular requirements (health status, visa, etc.) and must not have any legal requirements or official regulations that oppose his/her participation.

– The handling fees and other additional costs shall be borne by you and the replacement traveller. If the replacement traveller subscribes to the contract, you and the replacement traveller shall be jointly and severally liable for the payment of the travel price.  

– If you appoint the replacement traveller too late or if the replacement traveller is unable to participate, his absence will be considered as a cancellation.

3.3.1 If a new booking is made and the cancellation conditions allow it, the deposit or payment made from a previous cancelled booking can be transferred to a new booking. 

By their very nature, off-piste and heliskiing activities require a significant degree of flexibility on the part of the client, whether or not an activity can continue as planned depends on the weather and snow conditions encountered on the day of the activity.  Circumstances or cancellations may occur at the last minute, our guides and pilots have the absolute discretion to determine whether a descent or activity (or part of it) can proceed or continue as expected, in either case the client will be expected to follow the instructions set out to hear the PH team.

NO CHANGES OR CANCELLATIONS, COMPLETE OR PARTIAL, FOR ANY OF THE FOLLOWING REASONS: Delayed arrival at the heliport or activity, illness, injury or lack of ability or physical condition of the client, aircraft delays, presentation of travel documents that are not in order. If you cancel any program or activity, unused third party services will be reimbursed, provided that PH is not charged. In urgent cases (e.g. illness or accident of the person concerned, serious illness or death of a close relative), PH staff will assist you in arranging your premature return. Please note that you can take out insurance for repatriation costs, which is not covered in the price of the trip.

4. CANCELLATION AND ACCIDENT INSURANCE

4.1 CANCELLATION INSURANCE 

To avoid any costs that may be caused by unexpected cancellation or disruption, we strongly recommend obtaining cancellation insurance, as all deposits and payments are non-refundable. 

4.2 ACCIDENT INSURANCE 

Due to the nature of the activity, accident and rescue insurance is compulsory. PH is not responsible for costs associated with any medical treatment, evacuation and hospital transfers incurred before, during and/or after a booking, such costs being the sole and exclusive responsibility of the client. The client accepts that PH is not liable for any insured or uninsured losses. The client accepts that it is the client’s responsibility to understand the limitations and coverages of their insurance and in no event shall this be the responsibility of PH.

5. CANCELLATION AND CHANGES BY PH

5.1 CANCELLATION FOR REASONS FOR WHICH YOU ARE RESPONSIBLE

Pyrenees Heliski reserves the right to cancel any package or program, at any time, for any reason. You will be informed as soon as possible and PH will in this case make a full refund of all deposits and payments made, but will not refund any other costs or be liable for any other claims for damages.

5.2 CASES OF MAJOR FORCE AND STRIKES

Force major (natural disasters, epidemics, disturbances, etc.), governmental regulations or strikes may force PH to cancel the activity. If this is the case, PH will inform you as soon as possible. If the program is cancelled, PH will try to propose a replacement program of equivalent quality. If you participate in the replacement program, the price already paid will be allocated to the price of the replacement trip and you will be liable for any difference in price. If you do not participate in the replacement trip, you will be reimbursed the price of the trip already paid. Any further claims are excluded. 

6. CUSTOMER RESPONSIBILITIES

6.1 Customers are responsible for familiarizing themselves with the terms and conditions of PH prior to making any booking. It is also the client’s responsibility to fully understand the program or package booked, what is included and what is not included. 

6.2 Clients traveling from another country outside the European Union must be up to date with visa and entry requirements for Europe. No refunds will be given for refused admissions. 

6.3 Clients are responsible for being on time and prepared on activity days. Arriving late or ill-equipped may result in the client missing part or all of the contracted activity. No refunds will be given to clients who arrive late or are ill-equipped. 

6.4 It is compulsory for the client to complete our Declaration of Liability form before undertaking the activity. This document will affect the client’s rights and the client must ensure that they read and fully understand its contents, and will be required to sign it, either electronically or physically, before undertaking the activity with PH. Any client who has not correctly completed and signed the Statement of Responsibility will not be permitted to participate.

7. SKILLS

PH requires that all clients who are going to take part in heliskiing, off-piste and/or backcountry skiing activities must have an advanced level of skiing. Off-piste is a physical activity. It is recommended that all clients self-assess and prepare adequately for the activity. No refunds will be given to clients who are unable to complete the activity competently due to a lack of fitness or ski technique. If the client is unable to complete the activity due to lack of fitness or skill, the client will be transferred to base and will not be entitled to any refund.

8. POLICY FOR MINORS

At PH we welcome all clients over the age of 18 who wish to heliski. If any client under the age of 18 wishes to do an activity with us they must meet and/or follow the following conditions:

– The minimum age must be at least 12 years old on the day of the activity and have the ability and physical conditions to perform the activity. – The Declaration of Responsibility must be signed by the legal guardian or representative of the minor. 

The minor must be accompanied at all times during the activity by his/her legal guardian or representative. 

9. PH OPERATION 

9.1All clients undertaking a heliskiing or heli-transported activity must attend the safety and helicopter briefing prior to undertaking the activity.

9.2 If a client withdraws and/or cancels their place from any activity, PH reserves the right to use that place for the benefit of the company including, but not limited to, guide training, promotion, cost reduction, profit generation and without compensation of any kind. 

10. PRICE CHANGES AFTER CONCLUSION OF THE CONTRACT 

10.1 Exceptionally, it is possible that the initially agreed price may have to be increased. Price increases may take place following:  

(a) an increase in the cost of transport (including the cost of fuel); or

b) the introduction or increase of taxes or official charges; c) an increase in the cost of transport (including the cost of fuel)

d) price increases following official measures (e.g. value added tax). Increases in the cost of services included in the journey may be passed on to the traveller, resulting in an increase in the price of the journey.  PH will apply the price increase no later than 20 days prior to departure.

10.2 Modification of the program or change of transport plans between your booking and departure date  

PH reserves the right to modify, in its favor, the travel program or certain agreed services (e.g. accommodation, mode of transport, etc.) when unexpected or unavoidable costs so require. PH will make every effort to propose services of equal quality as a replacement. PH will inform you as soon as possible of such changes and their consequences on the price.

11. Events during the stay

Outside of the agreed travel program, it may be possible to register for local events or excursions during the trip. It is not excluded that such events or excursions involve certain risks and require physical fitness. The responsibility for participating in such events or excursions shall be borne solely by the customer. This general contract and the travel conditions apply to events and excursions organized by PH. Where such events and excursions are organized by third parties and PH staff merely act as intermediaries, you cannot benefit from the clauses contained in this general contract and travel conditions applicable to travel organized by PH. 

12. GIFT VOUCHERS: Gift Vouchers are valid for three years, the expiry date is indicated on the voucher and cannot be used after this date. The vouchers are valid for any personal inconvenience of the client or the company, giving sufficient time to carry out the activity. To make a reservation, the client must contact us within the period of validity by presenting the voucher in PDF format or a photo of it. The general conditions for booking and carrying out the activity apply according to the program. In the case of vouchers that do not meet the minimum number of participants according to the program, the conditions set out in point 4 apply. Vouchers are nominal, they can be transferred as long as they are valid and Pyrenees Heliski is informed in advance. The value of the voucher is not refundable in any case. 

13. DATA PROTECTION

Information about the client and their group, including their names, contact information and details are collected by PH at the time of booking. This data will be used to contact our clients in relation to bookings and promotions related to PH. We may also disclose this information to our service providers for the purpose of facilitating and carrying out your booking. Financial information will only be used to process payments. If a customer wishes to stop receiving mailings and/or information from PH they should let us know by emailing us at info@heliski.pro. In accordance with the applicable regulation on personal data, you also have the right to access, modify, oppose, limit, delete, and transfer your data, which you can exercise by contacting us. 

14. COPYRIGHT AND PUBLICATION OF PHOTOS AND VIDEOS.

14.1 Copyright: Pyrenees Heliski 

14.2 Media publication: I give permission to PH to use photos and videos where I appear for PH promotional and marketing material. 

15. COMPLAINTS

If you wish to make a complaint against a defect or request reimbursement or compensation from PH, you must do so in writing within 10 days of your return. Your complaint must be accompanied by confirmation from PH staff or the beneficiary and any supporting documents.  

16. SENTENCE

16.1 The relationship between you and PH is governed exclusively by Spanish law. PH can only be sued at its office at Vielha heliport.
